Terms of service
These Terms of Service (“Terms”) govern your use of Mercè, an Android companion guide to La Mercè, Barcelona’s festival, published on Google Play as dev.glippi.merce (“the App”). By downloading, installing or using the App, you agree to them. If you do not agree, do not use the App.
The App is published by the individual developer identified on the App’s Google Play listing (“the Developer”, “we”, “us”). You can reach us at the developer contact email shown in the Developer contact section of Mercè’s Google Play listing.
How the App handles information is described in the Privacy Policy, which forms part of these Terms.
What the App is
Mercè presents a copy of the published La Mercè programme and adds tools on top of it: a view of what is on now and next, the full programme filterable by day and category, search, and — under the one-time Mercè Pro purchase — live distance and compass bearing to venues, reminders, and calendar export. The programme itself is free to browse and does not expire.
Mercè is an independent, unofficial guide. It is not produced, operated, endorsed by, or affiliated with the Ajuntament de Barcelona, the festival’s organisers, or any official festival body.
Licence
Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use. All rights in the App’s software, design and branding that are not expressly granted here are reserved.
Programme information is not guaranteed
Event times, venues, line-ups, access conditions and pricing shown in the App are reproduced for convenience from the published programme. They may be incomplete, out of date, or changed by the organisers without notice, including at short notice during the festival itself. The App tries to reflect updates and to surface a change — a moved time, a moved venue, a cancellation — rather than hide it, but no guarantee is given that what it shows is complete or current.
Always confirm timing, access and safety information against official on-site signage and official festival sources before relying on it. Where the App and the organisers disagree, the organisers are right.
Nearby, directions and reminders are aids, not guarantees
Distances, compass bearings and walking-time estimates are approximate. They are straight-line calculations from your device’s own sensors and published venue coordinates; they do not know about closed streets, crowd control, or a route’s actual shape, and their accuracy depends on GPS conditions and on the device’s compass being calibrated. The “Directions” button hands off to a maps app of your choosing and the Developer is not responsible for what that app then shows you.
These are orientation aids for a large, busy street festival. They are not a substitute for paying attention to your surroundings, to traffic, to crowd density, or to venue staff and official signage.
Reminder notifications depend on your device’s operating system, its battery-optimisation settings, and the notification permission remaining granted. Where the exact-alarm permission is not granted, reminders fire within a window rather than at a precise moment. No guarantee is given that a reminder will always fire, or always fire on time, on every device.
Mercè Pro
Mercè Pro is a single, one-time purchase — not a subscription — that unlocks Nearby, reminders and calendar export. There is no recurring charge.
- The price is set and displayed by Google Play in your local currency, and is shown to you before you confirm anything.
- The purchase is billed, processed and fulfilled by Google Play, and is additionally subject to Google Play’s Terms of Service and Google’s own refund policies.
- Your entitlement is tied to the Google account that made the purchase, not to a particular handset. “Restore purchase” reinstates it after a reinstall or on a new device signed into that same account.
- Locked features remain visible and labelled in the App before purchase. The offer appears at the point you actually attempt one of them; nothing is fabricated behind a lock.
- Refunds are requested through Google Play — see Google’s refund help. We may also action a refund at our discretion on request.
- If a purchase fails, or an entitlement does not unlock correctly, write to the contact address above.
Nothing here limits statutory consumer rights, including any right of withdrawal, that apply to you under the law of your country of residence.
Acceptable use
You agree not to reverse-engineer, tamper with, or circumvent the App’s purchase or entitlement mechanism; not to interfere with the App’s operation or with the programme feed it relies on; and not to use the App for any unlawful purpose.
Intellectual property
The App’s software and design belong to the Developer. “La Mercè”, the festival’s name, and any official festival branding, artwork or programme content belong to their respective rights holders, including the festival’s organisers and the Ajuntament de Barcelona, and appear in or around the App for identification and informational purposes only. All trade marks are the property of their respective owners.
No warranty
The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including — to the fullest extent permitted by law — any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special or consequential loss arising from your use of, or inability to use, the App — including a missed event, an inaccurate programme detail, a reminder that did not fire, or a journey made on an approximate distance. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, and any mandatory consumer-protection rights you have.
Changes to the App and to these Terms
The App may be changed, suspended or discontinued in whole or in part at any time. You may stop using it at any time by uninstalling it. These Terms may be updated; the effective date above will change, and material changes will be noted in the App’s release notes on Google Play. Continuing to use the App after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection rights available to you under the law of your country of residence.
Contact
For anything about these Terms, a purchase, a bug, or a refund, write to the developer contact email shown in the Developer contact section of Mercè’s Google Play listing.
